Negligent security, or inadequate security, incidents are a type of premises liability case in which the landowner or possessor of property breaches their duty to keep the premises reasonably safe from attackers, gangs, sexual predators, thieves, robbers, and other violent criminal perpetrators, and as a result thereof, an invitee is hurt or killed.
These incidents occur in many places, including restaurants, malls, stadiums, bars, discotheques or clubs, swimming pools, apartment complexes, hotels, parks, and cruise ships. Although every security incident cannot be guaranteed to be prevented, landowners and possessors of property must implement safety measures that are reasonable under the circumstances, which at the very least reduce the probability of such incidents. Some of these measures include hiring security guards or off duty police officers, placing warning signs, installing video surveillance, increase area lighting, and the establishment of other safety policies and procedures according to industry standards. Many landlords and possessors of property simply fail to implement adequate, and sometimes have no safety measures in order to avoid increased costs and decreased profits, all at the expense of public safety.
